San Diego Out-of-State DUI Lawyer

Representing Out-of-State Drivers Arrested for Drunk Driving

If you are a non-California resident and have been arrested for DUI, it’s important to hire a lawyer who has experience defending out-of-state drivers charged with DUI. Not only will you face criminal charges in California, but you will also face license suspension and other possible repercussions in your home state as well. You want to work with a San Diego DUI attorney who knows what to do in this situation, and who can help you fight your charges both in and out of the state. At the Law Offices of Virginia Landry, you can rest assured that the attorney handling your case has extensive experience handling out-of-state DUI cases and can provide you with the type of aggressive representation you need to seek the best result.

Interstate Driver’s License Compact

Many out-state-drivers arrested for DUI do not realize they will face criminal charges in both California and in their home state. This occurs because of the Interstate Driver’s License Compact (IDLC). The IDLC is an agreement between member states to report a resident who commits a traffic offense in another state. As a member of the IDLC, the authorities in California have agreed to notify a driver’s home state if he or she has committed a traffic offense while in California. Therefore, if you are a non-California resident who was arrested on DUI charges while in California, the authorities in California will notify the law enforcement authorities in your home state of the offense.

There are only five states that are not members of the Interstate Driver’s License Compact: Michigan, Georgia, Wisconsin, Massachusetts, and Tennessee. If you are a resident of a non-member state, the authorities in California will still notify your home state of your DUI offense, but you may or may not face repercussions at home. You will however still be subjected to criminal prosecution in California.
